General Terms and Conditions of JAYA Indonesian Kitchen

1. General Provisions
Cinta Jaya GmbH (JAYA Indonesian Kitchen) applies these General Terms and Conditions (GTC) to all orders, reservations and services made via jayabistro.ch and the online shop. By placing an order or reservation, the customer confirms having read, understood and fully accepted these GTC. Cinta Jaya GmbH reserves the right to amend these GTC at any time; the version valid at the time of the order shall apply. The services are offered exclusively within Switzerland.
2. Registration and Ordering
2.1 Registration
The customer confirms providing complete and truthful information during registration. Cinta Jaya GmbH may send newsletters several times a year to registered phone numbers and email addresses. Unsubscribing is possible at any time via the link included in each newsletter.
2.2 Ordering
Orders are placed exclusively online via the webshop (“Order Now”). A contract is only formed once the ordering process has been completed. Cinta Jaya GmbH reserves the right to decline orders without giving reasons. Unavailable items are neither replaced nor delivered later; items already charged but not delivered will be refunded, with no further compensation claims. A minimum order value applies; any shortfall is automatically charged.
2.3 Changes/Cancellations
Changes or cancellations of orders and reservations are permitted up to 24 hours before the agreed time, and only during the restaurant’s opening hours.
2.4 Youth Protection
The sale of beer and wine is permitted from age 16, and spirits from age 18. The customer confirms meeting the applicable minimum age when placing an order. Staff may request proof of age when handing over alcoholic beverages; the item will not be delivered if this is refused.
3. Delivery and Pickup
Deliveries are made to the address provided by the customer; pickups take place at Seestrasse 77, 8703 Erlenbach ZH. Communicated time frames are non-binding estimates. No compensation or right of withdrawal can be derived from a late delivery or pickup.
4. Reservations
Table reservations can be made online at jayabistro.ch/reservieren or by phone. In case of a late arrival without prior notice, Cinta Jaya GmbH reserves the right to release the reserved table to other guests.
5. Prices and Payment
All prices are quoted in Swiss francs, including value-added tax. Payment can be made in cash or using the payment methods indicated in the restaurant or the webshop.
6. Liability
Guests with allergies or intolerances are kindly asked to inform our service staff directly before ordering (see Declaration). Online ordering is entirely at the customer’s own risk.
7. Severability
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid arrangement that comes closest to its economic purpose.
8. Governing Law and Jurisdiction
These terms are governed exclusively by Swiss law. The exclusive place of jurisdiction is the registered office of Cinta Jaya GmbH in Erlenbach ZH.
